These Terms and Conditions (“Terms”) govern your access to and use of the Secretly mobile application, website, and related dating services (collectively, the “Platform”), operated by Velora Labs LLP (“we”, “us”, “our”, or the “Company”).

By accessing, downloading, registering, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Secretly is a dating application for adults aged 18 and above. It lets you create a profile, discover other adults nearby, express interest, match, and chat. Certain features are available only to paid subscribers. Secretly is an introduction service only — we do not screen users beyond the safety and verification measures described in our Privacy Policy and Child Safety Policy, and we do not guarantee any outcome (a match, a relationship, or otherwise).

2. Eligibility

• You must be at least 18 years old to use the Platform. There are no exceptions.
• By using the Platform, you confirm that you are 18+, that you have the legal capacity to accept these Terms, and that your use is not prohibited by law in your jurisdiction.
• If you are found to be under 18, your account will be removed and any data deleted (subject to legal retention obligations).
• You may not use the Platform if you are a registered sex offender, have been convicted of a violent or sexual offence, or are otherwise prohibited by law from using a dating service.

3. Account Registration

• Account creation is required for most features and is performed via OTP-based mobile or email verification.
• You are responsible for the security of your registered phone number, email, OTP, and device.
• You agree to provide accurate, current, and complete information — including a real date of birth, real photos of yourself, and a profile that genuinely represents you.
• One person, one account. You may not maintain multiple profiles, impersonate any other person, or operate a profile on behalf of someone else.
• We may suspend or terminate accounts that are fake, impersonating, shared, or operated in violation of these Terms.

4. License & Usage Rights

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in seeking dating connections with other adults.

4.2 You Retain Rights to Your Content

You retain ownership of the photos, text, voice notes, and other content you submit (“User Content”). By submitting User Content, you grant Velora Labs LLP a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, distribute, and display that content solely to operate, secure, moderate, and improve the Platform. This licence ends when you delete the content or your account, except where we must retain it for legal, safety, or fraud-prevention purposes.

4.3 Restrictions — Community Guidelines

You agree not to use Secretly to:

• Misrepresent your identity, age, gender, photos, marital status, location, or intentions.
• Post or send any nudity, sexually explicit imagery, or sexually explicit messages to anyone who has not clearly consented, or to anyone at all where prohibited by law or our policies.
• Post, share, request, or solicit any content involving minors, including any Child Sexual Abuse Material (CSAM). This is an absolute, zero-tolerance prohibition — see our Child Safety & CSAE Policy.
• Engage in harassment, stalking, hate speech, threats, intimidation, or incitement against any person, community, religion, caste, region, or sexual orientation.
• Engage in sex work, escort services, sugar arrangements, paid companionship, trafficking, or any commercial sexual solicitation.
• Run romance scams, financial scams, investment / crypto scams, phishing, blackmail, sextortion, or fraud of any kind.
• Use Secretly for marketing, recruiting, MLM, religious / political proselytising, or to drive traffic to other platforms or services.
• Share another person’s private information, intimate images, or chats without their explicit consent (no doxxing, no revenge / leaked content).
• Upload viruses, malicious code, or any technology that disrupts or harms the Platform.
• Reverse engineer, scrape, bulk-download, or attempt to extract source code, data, prompts, or APIs.
• Resell, sublicense, or commercially exploit any part of the Platform, including paid features and subscription privileges.
• Share your account, OTP, or active subscription with others.

5. Safety, Moderation & Reporting

• We use automated systems and trained human moderators to detect underage users, nudity, harassment, scams, and other violations. Some content may be reviewed by AI / human moderators before or after publication.
• You can report a profile, message, photo, or chat from within the App at any time. We aim to acknowledge reports within 24 hours and to review high-risk reports (child safety, threats of violence, self-harm) on priority.
• You can block any user at any time. Blocked users cannot see your profile, send you messages, or contact you.
• Meeting in person is at your own discretion and risk. Meet in a public place, tell a friend, and trust your instincts. Velora Labs LLP is not responsible for the conduct of any user on or off the Platform.

6. Subscription, Pricing & Payments

• Premium features (extra likes, see-who-liked-you, advanced filters, boosts, etc.) are available through paid subscription plans and / or one-time purchases.
• Current pricing is displayed inside the App / website and on the paywall screen at the time of purchase.
• Prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices may change at any time without prior notice; existing active subscriptions remain at the price agreed at purchase until renewal.
• Payments are processed securely via RBI-licensed payment gateway partners (such as Razorpay, PhonePe, or similar providers) supporting UPI, cards, netbanking, and UPI Autopay. The active payment gateway may change from time to time without prior notice.
• We do not store your full card or banking details on our servers.
• Subscriptions auto-renew via UPI Autopay or card mandate until cancelled. See our Payment & Cancellation Policy for full details.

7. Refund & Cancellation

• You may cancel auto-renewal at any time before the next billing cycle. Cancellation prevents future charges; current period access continues until expiry.
• Due to the digital nature of the content, all completed payments are non-refundable except where required by applicable law or as expressly described in the Payment & Cancellation Policy.

8. Disclaimer — Introductions, Not Outcomes

• Secretly is an introductions platform. We do not guarantee that you will find a match, a date, a relationship, or any specific outcome.
• We do not perform background checks, criminal record checks, or identity verification beyond the safety measures described in our Privacy Policy and Child Safety Policy. You should exercise your own judgment when interacting with other users.
• You are solely responsible for your conduct, communications, and interactions with other users, both on and off the Platform.
• We do not endorse any user and make no representations about the character, background, or intentions of any user.

9. Intellectual Property Rights

• All branding, designs, software, code, AI models, prompts, and underlying systems on the Platform are owned by, licensed to, or licensed by Velora Labs LLP.
• You receive a personal-use license only; no ownership transfers to you.
• Unauthorised commercial reproduction, redistribution, or modification may result in legal action under the Copyright Act, 1957 and related laws.

10. Third-Party Services

• The Platform integrates third-party services such as payment gateway partners (e.g., Razorpay, PhonePe), OTP delivery providers, push-notification services, AI / moderation providers, cloud storage and content-delivery providers, and analytics tools.
• These services operate under their own terms and privacy policies. We are not responsible for their independent functionality or policies.

11. Suspension & Termination

We may suspend or terminate your account, with or without notice, if:

• You violate these Terms, the Community Guidelines, the Child Safety Policy, or applicable law.
• You are, or are suspected to be, under 18.
• You impersonate another person, run a fake or commercial profile, or operate multiple accounts.
• Other users report you and our review confirms a violation.
• Payments fail, are disputed, or chargedback.
• Required by court order or government authority.

Termination for child-safety, sex-trafficking, or violent-conduct violations is permanent and may be reported to law enforcement and to relevant bodies such as NCMEC.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an “as is” and “as available” basis.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for the actions or omissions of other users, on or off the Platform, including any harm, fraud, harassment, or injury caused by another user.
• We are not liable for any indirect, consequential, or incidental damages.
• Our aggregate liability to you for all claims relating to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or INR 1,000, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Velora Labs LLP, its partners, officers, employees, and contractors from any claims arising from:

• Your use or misuse of the Platform
• Your interactions with other users, on or off the Platform
• Your violation of these Terms, the Community Guidelines, or the Child Safety Policy
• Your infringement of any third-party right, including intellectual property, privacy, and right of publicity

14. Privacy Policy & Child Safety

Your use of Secretly is also governed by our Privacy Policy and Child Safety & CSAE Policy, which form part of these Terms.

15. Modifications to Terms

• We may update these Terms at any time. Material changes will be communicated through the App or website.
• Continued use of the Platform after updates means you accept the revised Terms.

16. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Disputes shall fall under the exclusive jurisdiction of courts in Ranchi, Jharkhand.
